1. Acceptance of Terms
By accessing or using Neztio (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. About Neztio
Neztio is an early-access childcare management platform designed for childcare providers and operators. During early access, Neztio may change frequently as we iterate with a small number of partners. We reserve the right to modify or discontinue the Service (or any part of it) at any time without notice.
3. Eligibility and Account Registration
You must be at least 18 years old to use Neztio. To request early access or a demo, you may need to provide basic contact and organisational information. You agree to provide accurate, current and complete information and to keep it updated.
4. Early Access
Because Neztio is in early access, we may onboard a limited number of centres to use the Service. Participation in early access does not create any obligation on Neztio's part to provide the Service generally or to continue providing it to any particular participant. We reserve the right to refuse early access to anyone for any reason.
5. Use of the Service
You agree to use Neztio only for lawful purposes and in accordance with these Terms. You will not (a) reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission; (b) interfere with or disrupt the Service or servers; or (c) attempt to gain unauthorised access to the Service or related systems.
6. Intellectual Property
Neztio and its content, features and functionality are owned by Neztio LLC and are protected by copyright, trademark and other laws. You may not use Neztio's name, logo or other trademarks without our prior written consent.
7. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using Neztio, you consent to the collection and use of your information as set out in that policy.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. Neztio does not warrant that the Service will be uninterrupted, error-free or secure. You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, Neztio and its founders, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use or goodwill, resulting from (a) your use or inability to use the Service; (b) any unauthorised access to or use of our servers and/or any personal information stored therein; or (c) any other matter relating to the Service.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Sections 6 through 10 of these Terms will survive termination.
11. Governing Law
These Terms and any disputes arising out of or relating to them are governed by the laws of the State of Utah, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Salt Lake County, Utah.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last Updated” date at the top of this page. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.
